Abstract


A study on violence against women, a reality facing the Bashi traditions in the cluster of Bugorhe, allowed us to discover the value and the place of women in traditional society Bashi. However, force is to note that women's rights are violated or trampled in the Bashi traditions in the group Bugorhe. Most of the violence whose victims are women in the group Bugorhe are rooted in traditional practices (habits and customs), harmful and infringing certain rights for women like those in the legal instruments Bugorhe both national and international (Art.1er, 2 (1), 7; 10 UDHR, art .2 (1); 3PIDCP; art.2 (2) ICESCR .2,3 art of the African Charter of human rights Human and Peoples art.1er, 14 of the Convention on the elimination of all forms of discrimination against women and art.11,12,13 and 14 of the Constitution of 18 February 2006 and article 8 career status of the civil service in DR Congo). In addition, other violence come from use with impunity of violence or coercion, abuse in the family, forced marriages, the wife of adultery murders....

Une étude portant sur la violence à l’égard de la femme, une réalité face aux traditions Bashi dans le groupement de Bugorhe, nous a permis de découvrir la valeur ainsi que la place de la femme dans la société traditionnelle de Bashi. Cependant, forcer est de constater que les droits de la femme sont violés voire bafoués dans les traditions Bashi dans le groupement de Bugorhe. La plupart des violences dont se trouvent victimes les femmes dans le groupement de Bugorhe trouvent leur fondement dans certaines pratiques traditionnelles(us et coutumes), nuisibles et portant atteinte à certains droits reconnus aux femmes à l’instar de celles de Bugorhe par les instruments juridiques tant nationaux qu’internationaux (Art.1er, 2(1),7 ;10 DUDH, art .2(1) ; 3PIDCP ; art.2(2) PIDESC, art .2,3 de la charte africaine des droits de l’Homme et des Peuples ; art.1er, 14 de la convention sur l’élimination de toutes formes de discrimination à l’égard des femmes et art.11,12,13 et 14 de la Constitution du 18 février 2006 et art.8 du statut de carrière de la fonction publique en RD Congo). De plus, d’autres violences proviennent de l’usage en toute impunité de la violence ou contrainte, les sévices dans la famille, les mariages forcés, les meurtres d’épouse par adultère….
