The Congolese state by its constitution of February 18, 2016 in Articles 22 and 37 enshrines the rights free access to any person to express his faith through a church of their choice. However, this freedom is often badly exploited by the followers of these churches called awakening, the most involved in day length pray and sing ignoring the neighborhood that is to say the environment in which they operate. The sounds they produce are an inconvenience to others, which sounds prejudice to the environment. These uproars are often a source of conflict between the authors and the surrounding people often feel a pop, so that some people are forced to enter the judicial bodies or municipal authorities to stress the churches to reduce their noise or outright stop. But often these disputes are ongoing and the state fails to apply the rigor of the law in this matter against offenders. While CCCLIII Article 258 provides for penalties and compensation from the author of the unlawful act to benefit the victims of these uproars.

L’Etat congolais par sa constitution du 18 février 2016 à ses articles 22 et 37 consacre les droits libres accès à toute personne d’exprimer sa foi à travers une église de son choix. Cependant, cette liberté est souvent mal exploitée par les adeptes de ces églises dite de réveil dont la plus part à longueur de la journée prient et chantent ne tenant pas compte du voisinage c'est-à-dire de l’environnement dans lequel elles évoluent. Les bruits qu’elles produisent constituent un dérangement à autrui, lesquels bruits préjudicient à l’entourage. Ces tapages sont souvent source des conflits entre les auteurs et les personnes environnantes, qui se sentent souvent gêner, ce qui fait que certaines gens sont obligées de saisir les instances juridictionnelles ou les autorités municipales pour contraindre les églises de diminuer leurs bruits ou carrément de cesser. Mais souvent, ces différends sont permanents continuels et l’Etat n’arrive pas à appliquer la rigueur de la loi en cette matière à l’égard des contrevenants. Alors que le Code Civil Congolais Livre III à l’article 258 prévoie des sanctions et de réparation de la part de l’auteur de l’acte infractionnel au profit de la victime de ces tapages.
