Since 1885, therefore, two major land-grabbing systems coexisted and found themselves in conflict in the DRC. In 1908, the Congo Free State committed itself to respect the existing practices in the Congo, as well as legally acquired rights to third, indigenous and European settlers. It is only with the new land law that soil and subsoil became the exclusive property of the state. This reflected the land management exclusion that customary chiefs had on the part they ran.

Abstract

Depuis 1885 donc, deux grands systèmes d’appropriation des terres ont coexisté et se sont trouvés en conflit en RDC. En 1908, l’État indépendant du Congo s’est engagé à respecter les pratiques existantes au Congo, ainsi que les droits acquis légalement reconnus à des tiers, indigènes et colons européens. C’est seulement avec la nouvelle loi foncière que le sol et le sous-sol est devenu la propriété exclusive de l’Etat. Cela a traduit l’exclusion sur la gestion de terre qu’avaient les chefs coutumiers sur la partie qu’ils dirigeaient.
