Africa is committed on the path of free movement of persons; the success of this process depends on its ownership by its member states, but above all on the dynamics within the African subregional and regional economic communities which constitute the pillars of the implementation of the African Economic Community. Examining governance and the challenges of free movement of persons within these communities provides a picture of the challenges facing the African Union in making effective the free movement of persons, the right of residence and establishment throughout the continent. These challenges are of various kinds, including those related to sovereignist assertions, socio-economic constraints, security concerns, overlapping economic communities, and extra-African migration cooperation. However, these challenges are not fatal, and this contribution opens up avenues for reflection on each of the challenges, as well as the African and global context that is emerging favorable, more than yesterday, to the establishment of free movement in Africa.

Abstract

L’Afrique s’est engagée sur la voie de la libre circulation des personnes, le succès de ce processus dépend de son appropriation par ses Etats membres, mais surtout des dynamiques au sein des communautés économiques sous-régionales et régionales africaines qui constituent les piliers de la mise en œuvre de la Communauté économique africaine. Se pencher sur la gouvernance et les défis de la libre circulation des personnes au sein de ces communautés offre l’image des défis qui se posent à l’Union africaine pour rendre effective la libre circulation des personnes, le droit de résidence et d’établissement sur l’ensemble du continent. Ces défis sont des divers ordres, notamment liés à des affirmations souverainistes, aux contraintes socio-économiques, aux préoccupations d’ordre sécuritaire, au chevauchement des communautés économiques, ainsi qu’à la coopération migratoire extra-africaine. Cependant, ces défis ne sont pas fatals, et cette contribution ouvre les pistes de réflexion sur chacun des défis, ainsi que le contexte africain et mondial qui se dessine favorable, plus qu’hier, à l’instauration de la libre circulation en Afrique.
