Legal insecurity regarding land in the DRC stems partly from weak law enforcement and partly from a lack of awareness of legal mechanisms and customary practices to protect legally acquired land. In this context, our article aims to raise awareness among Congolese concessionaires and potential land buyers about the importance of legal and extra-legal techniques that allow for the peaceful enjoyment and protection of land and real estate, often targeted by malicious actors such as false claimants and land agents in the absence of adequate safeguards. Research findings reveal that in the city of Mbandaka, in particular, some individuals posing as rightful claimants—often in collusion with land affairs agents or certain political-administrative authorities—spread fear and unlawfully resell plots belonging to legitimate owners who failed to take preventive measures. Studies show that proper enforcement and respect for land legislation—which recognizes land titles, particularly the certificate of registration—as well as the implementation of certain extra-legal practices such as fencing and land development, constitute effective measures for securing land ownership for Congolese citizens.

L’insécurité juridique foncière en RDC résulte à la fois de la faible application des lois et de l’ignorance des mécanismes juridiques et des pratiques coutumières permettant de protéger les terrains régulièrement acquis. Dans ce contexte, notre réflexion vise à sensibiliser les concessionnaires congolais, ainsi que ceux qui souhaitent acquérir des terrains, à l’importance des techniques juridiques et extra-juridiques qui leur permettent de jouir paisiblement de leurs biens fonciers et immobiliers, souvent convoités par des individus malintentionnés tels que des faux ayants droit ou des agents fonciers, en l’absence de protection adéquate. Les résultats de la recherche révèlent que dans la ville de Mbandaka, en particulier, certains individus se faisant passer pour des ayants droit, parfois en collusion avec des agents des affaires foncières ou certaines autorités politico-administratives, sèment la terreur en violation des lois foncières et pénales, en revendant illégalement des terrains appartenant à des propriétaires ne prenant pas de précautions. Ainsi, les études démontrent que la bonne application et le respect des dispositions de la loi foncière — notamment la reconnaissance des titres de propriété comme le certificat d’enregistrement — ainsi que la mise en œuvre de certaines pratiques extra-juridiques comme l’érection de clôtures ou la mise en valeur des terrains, constituent des mesures efficaces de sécurisation des biens fonciers des citoyens congolais.
