Abstract


The object of this study concerns the definition of the independent administrative authorities, its genesis and its evolution in Morocco and within the compared systems. The study also demonstrates that some analyzes try to give a narrow definition to independent administrative authorities and only see those who dwell on administrative decisions as the only one that can be considered an independent administrative authority. While other analyzes give it a broad definition, estimating that the mere fact of issuing opinions, proposals and recommendations is enough to consider it an independent administrative authority. Finally, the study focuses on the delegation of regulatory power to independent administrative authorities as well as their participation in public decision-making.

Abstract: (french)


L’objet de cette étude porte sur la définition des autorités administratives indépendantes, sa genèse et son évolution au Maroc et au sein des systèmes comparés. L’étude démontre également que certaines analyses tentent de donner une définition étroite aux autorités administratives indépendantes et ne voient que celles qui s’attardent sur les décisions administratives est la seule qui peut être considérée comme une autorité administrative indépendante. Alors que d’autres analyses lui donnent une définition large estimant que le simple fait d’émettre des avis, des propositions et des recommandations suffit de la considérer comme une autorité administrative indépendante. Enfin, l’étude se focalise sur la délégation du pouvoir réglementaire aux autorités administratives indépendantes ainsi que leur participation à la décision publique.
