A study of "equality of the parties in Congolese law; If the high instance of Bukavu court "; has allowed us to discover how the Congolese judicial bodies in this case the High Court applies the principle of Bukavu for a fair judicial and mechanisms established by law for such a guarantee. However; it is clear that the principle is violated at several levels of the proceedings in the sense that the Congolese judicial practice has so far been in line with legal texts guaranteeing equal parts yet guaranteed by the Constitution of the DRC (Article 48 of the DR constitution. 18 feb 2006 Congo). Moreover; we found that the characteristics of a fair trial that define (or determine) the civilized nations (democratic) are not observed or better monitored by the courts or judges for a free justice Congolese suspicion and corruption and that we allows to assert vehemently that standards guaranteeing human rights are respected in DR Congo; a considerable effort must be made by the authorities because the development of the country also depends.

Une étude portant sur « l'égalité des parties au procès en droit congolais ; cas du tribunal de grande instance de Bukavu » ; nous a permis de découvrir la manière dont les organes juridictionnels Congolais en l'occurrence le tribunal de grande instance de Bukavu applique le principe pour une justice équitable et ainsi que les mécanismes mis en place par la loi pour une telle garantie. Cependant ; force est de constater que le principe est violé à plusieurs niveaux de la procédure en ce sens que la pratique judiciaire congolaise n'a jusqu'ici été conforme aux textes légaux garantissant l'égalité des parties pourtant garantie par la constitution de la RDC (Art.48 de la constitution de la RD. Congo du 18fév.2006).
De plus ; nous avons pu constater que les caractéristiques d'un procès équitable qui définissent (ou déterminent) les nations civilisées (démocratiques) ne sont pas observées ou mieux suivies par les juridictions ou juges congolais pour une justice exempte de suspicion et de corruption et qui ne nous permet pas d'affirmer avec véhémence que les normes garantissant les droits humains sont respectées en RD Congo ; un effort considérable doit être fourni par les autorités car le développement du Pays en dépend aussi.
