All the threats to the environment today are due to economic activities carried out without ecological precautions and this everywhere in the world. To mitigate the effects of these, several legal, judicial and institutional practices are called to awakening. Hence the emergence and validity of good governance in the mining sector. Some laws in the world do not better ensure the protection of the environment. It is who if the future of the environment is not guaranteed, it will cause inconvenience to future generations. Concerning the DR Congo for example where we find in the mining legislation the application of strong sustainability, which is based on the monopoly to exploit everything and reinvest in other sectors. The designer of this system was not wrong; on the other hand, it is incompatible with certain States like the DRC where the management is not well ensured by the rulers.

Abstract

Toutes les menaces que subissent l’environnement aujourd’hui, sont dues aux activités économiques exercées sans précaution écologique et cela partout au monde. Pour atténuer les effets de celles-ci, plusieurs pratiques juridique, judiciaire et institutionnelle sont appelées à l’éveil. D’où l’apparition et le bienfondé de la bonne gouvernance dans le secteur minier. Certaines législations au monde n’assurent pas mieux la protection de l’environnement. C’est qui fait si l’avenir de l’environnement n’est pas garanti, cela entrainera des inconvénients aux générations futures. Concernant la RD Congo par exemple où on trouve dans la législation minière l’application de la soutenabilité forte, qui est assise sur le monopole de tout exploiter et réinvestir dans d’autres secteurs. Le concepteur de ce système n’avait pas tort, par contre cela est incompatible avec certains Etats comme la RDC où la gestion n’est pas bien assurée par les gouvernants.
