Abstract


The country Constitution and laws guarantee the freedom and inalienable fundamental rights to every citizen. Among these rights, one recovers the principle of the double degree of jurisdiction by the national, regional, and international, instruments as well. Such is the content of the article 21 of the Constitution of the DRC which states that" (…) The right to review a judgment is guaranteed to all (…) ". However, the article 168 of the same text says that" The decisions of the constitutional Court are not susceptible of any revision and are immediately enforceable… ", what a contradiction! The present survey raises the inconveniences of this disposition towards the people in front of the constitutional Court and comes to the conclusion that it is an attempt of the right to an equitable trial.

Abstract: (french)


La Constitution et les lois du pays garantissent à chaque citoyen des libertés et des droits fondamentaux inaliénables. C’est ainsi que les instruments tant nationaux, régionaux qu’internationaux postulent qu’une personne traduite en justice bénéficie du double degré de juridiction. C’est le libellé de l’article 21 de la Constitution de la RDC qui dispose que « (…) Le droit de former un recours contre un jugement est garanti à tous (…) ». Or, d’après l’article 165 « Les arrêts de la Cour constitutionnelle ne sont susceptibles d’aucun recours et sont immédiatement exécutoires…». La présente étude relève les inconvénients de cette disposition à l’endroit des personnes justiciables de la Cour constitutionnelle et arrive à la conclusion qu’il s’agit là d’un mépris du droit à un procès équitable. Elle propose ainsi, de lege ferenda, la suppression du privilège de juridiction ou l’institution d’une chambre d’appel au sein de la même juridiction pour statuer sur le recours de ses justiciables.
