The commercial profession is subject to strict rules regarding conflicts of interest, aimed at preventing situations where a merchant might be tempted to prioritize personal interests over those of their clients. In this context, legal restrictions on marriage can be seen as an extension of these rules, intended to prevent potential conflicts of interest that may arise from a merchant marrying someone with connections to their clients or suppliers. However, such restrictions may be viewed as infringing upon individual freedom and the right to marry. Moreover, they can be challenging to enforce in practice, given the difficulty of determining whether a person is involved in a specific commercial relationship. Ultimately, the justification for restrictions on merchants’ marriages will depend on various factors, including the nature of the commercial profession, the scope of commercial relationships involved, and the individual rights at stake. Therefore, authorities such as civil registries, bar associations, judicial councils, and national orders of certified accountants must carefully examine each case to determine if marriage restrictions are justified in the particular circumstances of the case.

La profession commerciale est soumise à des règles strictes en matière de conflits d’intérêts, qui visent à prévenir les situations dans lesquelles un commerçant pourrait être tenté de favoriser ses intérêts personnels au détriment de ceux de ses clients. Dans ce contexte, les restrictions imposées par la loi en matière de mariage peuvent être considérées comme une extension de ces règles, visant à prévenir les conflits d’intérêts potentiels qui pourraient résulter du mariage entre un commerçant et une personne ayant des liens avec ses clients ou ses fournisseurs. Cependant, cette restriction peut être considérée comme une atteinte à la liberté individuelle et au droit au mariage. De plus, elle peut être difficile à appliquer en pratique, car il peut être difficile de déterminer si une personne est interposée ou non dans une relation commerciale donnée. En fin de compte, la question de savoir si les restrictions sur le mariage des commerçants sont justifiées dépendra de divers facteurs, tels que la nature de la profession commerciale, la portée et l’étendue des relations commerciales impliquées, ainsi que les droits individuels en jeu. L’autorité de l’état civil, le bareau, le conseil superieur de la magistrature, l’ordre national des expert comptables etc, devront donc examiner attentivement chaque cas pour déterminer si les restrictions sur le mariage sont justifiées dans les circonstances particulières de l’affaire.
